Questions and explanations

What are conditions of participation under the Procurement Act?

They are conditions concerning a supplier’s legal and financial capacity or technical ability to perform the contract.

They must be proportionate to the nature, complexity and cost of the procurement.

They assess the supplier’s capability, whereas award criteria assess the merits of the tender.

Read them early because a supplier that cannot satisfy a required condition cannot ultimately receive the contract, however persuasive the rest of its written proposal may be.

Sources and context

Factual basis compared with retrieved primary/official material; retrieval scope and limitations are recorded in the source register. Not independent professional approval.

Are conditions of participation the same as scored quality questions?

No. Conditions establish whether a supplier has the relevant capacity or ability; award criteria determine the merits of its tender.

In a competitive flexible procedure, conditions can also support an objectively stated shortlist.

Once the supplier has met the conditions, the tender must be assessed against the award criteria without importing a separate participation ranking into that assessment.

A bid team should therefore track qualification evidence separately from the contract-specific quality response.

Can a buyer require audited accounts from a company that is not legally required to have an audit?

Under the Procurement Act conditions-of-participation rules, a buyer cannot require audited annual accounts from a supplier that is not otherwise required to have them under the Companies Act or an overseas equivalent.

Alternative evidence of financial capacity must be considered.

This does not mean financial capacity is irrelevant or that all small businesses automatically qualify.

Ask which proportionate evidence will satisfy the particular financial condition and supply it accurately.

Must contract-specific insurance already be in place when a supplier applies?

The Act prohibits requiring insurance relating to contract performance to be in place before award as a condition of participation.

The buyer can seek appropriate evidence that the required cover can be obtained, and other legal insurance obligations remain relevant.

Check the tender’s precise evidence and implementation requirements and clarify any ambiguity.

Do not assume that this protection removes the eventual insurance requirement or permits the supplier to promise cover it cannot obtain.

Can a buyer insist on previous work for that same public organisation?

A participation condition cannot require prior award by a particular contracting authority.

Relevant experience can still be assessed where proportionate, and the guidance distinguishes specific-buyer experience from broader relevant experience.

If the wording appears to require work for the same buyer, ask for clarification and propose evidence of equivalent delivery capability.

Explain the scale, complexity and results of the comparator contract rather than relying only on the client’s name.

Does the Procurement Act require every buyer to use the old standard selection questionnaire?

No. The Act does not prescribe the same Single Procurement Document approach as the previous regulations.

Buyers can use participation templates that comply with the Act.

Follow the actual requested format and distinguish reusable core supplier information from procurement-specific evidence.

A familiar questionnaire label does not establish that every old rule still applies, and the absence of that label does not remove the buyer’s ability to assess proportionate capacity and capability conditions.

Can a supplier rely on another organisation to satisfy participation requirements?

The Act allows reliance on third-party capacity in relevant circumstances, with rules governing evidence and the relationship to performance.

Identify the organisation, the capability being relied upon and how it will be available for the contract.

The buyer may require a binding arrangement or relevant subcontracting commitments and must consider associated-person exclusion issues.

A general letter praising the bidder is different from credible evidence that the necessary resources will be available.

When must a supplier satisfy the conditions of participation?

Every condition must be satisfied before award, but the authority can determine appropriate assessment and progression points within the procedure.

The guidance recognises that an authority may allow a supplier to progress while a condition is being completed, provided the process complies with the Act and equal treatment.

Read the published rules rather than assuming a later certificate will always be accepted.

Seek clarification before investing in a bid that depends on deferred compliance.

Can a buyer request evidence independently verifiable by a third party?

Yes. The guidance explains that a buyer can require evidence verifiable by a third party, such as bank information or a relevant independent rating, while keeping the burden proportionate.

The right evidence depends on the condition and procurement.

Before sharing it, confirm that it relates to the bidding entity and the required period.

If the requested evidence is unavailable, ask whether another verifiable source can demonstrate the same underlying capacity.

Does meeting every participation condition mean the bidder will win?

No. Meeting the conditions establishes that the supplier is capable and eligible to proceed or receive the contract, subject to the other applicable checks.

It does not establish that the tender is the most advantageous under the award criteria.

Allocate effort to both stages: verify the qualification evidence, then develop the specific solution, delivery commitments and pricing requested by the buyer.

Strong company credentials alone cannot substitute for an answer to the evaluated contract requirements.
