When did the Procurement Act 2023 procurement regime begin?
The new regime commenced on 24 February 2025.
That date is the starting point for deciding which rules apply, but it does not convert every existing public contract into an Act contract.
First identify when the procurement legally commenced, the contracting authority and any framework or other arrangement being used.
A contract awarded after the commencement date can still belong to the previous regime if it arose from a procurement or commercial arrangement preserved by the transitional rules.

Do contracts procured under the Public Contracts Regulations 2015 automatically move to the new Act?
No. The transitional guidance preserves the previous legislation for procurements commenced under it and for the management of the resulting contracts.
That includes relevant extensions, modifications and termination.
A contract manager should retain the original procurement reference and legal regime in the contract record.
Using a current Procurement Act template for a legacy variation does not make the new Act the correct legal basis for that variation.

Does the Procurement Act 2023 apply uniformly across all four UK nations?
No. Devolved Scottish authorities generally continue under Scottish procurement legislation, while reserved authorities can operate under the Act even when buying in Scotland.
Devolved Welsh and transferred Northern Ireland authorities fall within the Act with specific differences.
The rules of a framework or joint procurement can also depend on the authority that established or leads the arrangement.
Identify the authority and arrangement rather than deciding solely from the delivery postcode.

Can a tender issued in 2026 still use the previous procurement regulations?
Yes, a procurement or call-off can remain governed by the previous legislation where the transitional provisions preserve that route.
The calendar year of an invitation is not a complete legal test.
Check the originating framework, dynamic purchasing system or procurement, its establishment or commencement date and the relevant saving provisions.
If the documentation mixes old and new terms, ask the authority to clarify the governing regime before assuming the latest terminology changes it.

Which rules govern a call-off from a framework established before 24 February 2025?
The transitional guidance generally preserves the previous rules for legacy frameworks and the contracts awarded under them.
The correct route is to inspect the framework documentation and its legal history, then apply the relevant saved regime to the call-off and its management.
Do not automatically import the Procurement Act standstill, notice or modification rules because the call-off is being awarded after February 2025.
Framework duration and transitional limits also need checking.

Why should a bid team record the legal regime at its first review?
The regime determines terminology, procedure, supplier information, notices, feedback rights and potential challenge deadlines.
Record the applicable legislation, authority type, procurement commencement date and any originating commercial arrangement alongside the tender reference.
This short control helps reviewers spot a copied instruction or template that belongs to another regime.
It also prevents the commercial team from assuming that contract management rules change merely because the bid is submitted in a later year.

Can an English buyer use a Welsh framework without considering Welsh procurement rules?
The location of the buyer does not remove the rules attached to the procurement arrangement.
Official guidance explains that authorities using a devolved Welsh arrangement must follow the applicable Welsh provisions and regulations for that arrangement.
A supplier should therefore inspect the framework terms and the origin of the arrangement.
A simple England-only checklist may omit relevant Welsh notice or policy differences even when the call-off customer is based in England.

Does selling to a public organisation always mean the full Procurement Act competition rules apply?
No. You must establish whether the buyer is a contracting authority, whether the transaction is a procurement within scope, whether an exemption or special regime applies and whether the estimated value reaches the relevant threshold.
Below-threshold contracts can have a different set of obligations.
Authority identity and contract value are useful screening facts, but neither alone establishes the complete route.
The buyer should state the procedure and applicable requirements in its procurement documents.

Can a supplier choose the procurement regime that appears easiest?
No. The legal regime follows the authority, contract, procurement history and applicable legislation; it is not a bidder preference.
A supplier can ask for clarification when the chosen route appears inconsistent or an arrangement is unclear.
Keep the clarification focused on the governing provisions and practical consequences, such as the applicable submission stage or feedback route.
Do not disregard a stated deadline while waiting for the authority to explain its position.

How should a knowledge base label UK procurement law answers?
Use the governing regime and jurisdiction explicitly, together with the date checked.
An answer about a new Procurement Act contract should not be presented as automatically covering Scottish devolved procurement or a legacy PCR framework.
Include material exceptions in the answer itself so that an isolated search result remains intelligible.
When an answer concerns a particular dispute or mixed arrangement, direct the reader to the relevant documents and current specialist advice rather than treating a general FAQ as a determination.
